Obtaining a Construction License

The central executive authority that implements state policy on state architectural and construction control and supervision is the State Architectural and Construction Inspection of Ukraine (DABI of Ukraine).
A construction license is an entry in the Unified Register that grants the right to construct facilities which, by the class of consequences (responsibility), belong to facilities with medium (CC2) and significant (CC3) consequences, according to the list of types of work determined by the Cabinet of Ministers of Ukraine, taking into account the specifics defined by the Law of Ukraine “On the Regulation of Urban Planning Activities.”
By Resolution of the Cabinet of Ministers of Ukraine dated March 30, 2016, No. 256, the lists of activities subject to licensing have been approved.
Under the law, facilities are divided according to the following classes of consequences (responsibility):
- Minor consequences – CC1
- Medium consequences – CC2
- Significant consequences – CC3
To obtain a permit to carry out construction work, it is necessary to submit quite an extensive list of documents:
- The original application for obtaining the permit with a signature and seal (if available);
- A certified copy of the document confirming the right of ownership or the right to use the land plot, or a copy of the superficies agreement;
- A copy of the regulatory document on the comprehensive reconstruction of quarters/micro-districts with outdated housing stock in the event of conducting such comprehensive reconstruction (for details, see the Comment or the service information card);
- The project documentation for the construction, agreed upon and approved in the established manner;
- A copy of the document confirming the right of ownership to a building or structure, or the owner’s consent, certified in accordance with the law, to carry out construction work in the case of reconstruction, restoration, major repairs, or technical re-equipment of existing enterprises;
- Copies of documents on the appointment of persons responsible for carrying out construction work, as well as persons who perform author’s and technical supervision;
- Information about the license that grants the right to carry out construction work, and qualification certificates.
The cost and timeframe for obtaining a license depend on the type of work.
